General terms and conditions<\/h5>
\n

The carrier agrees to transport the goods described in this document, subject to the terms prescribed by the Commercial Vehicles Act<\/strong> and the regulations of the province of origin<\/strong>, unless otherwise indicated below. By accepting this delivery, the consignee and shipper agree to be jointly and severally liable<\/strong> for the transportation charges.<\/p>\n\n\n\n

The full payment<\/strong> must be made within 15 days<\/strong> of the invoice date. Any overdue account will be subject to a charge of 2% per month<\/strong>.<\/p>\n<\/div><\/div>\n\n\n\n

BILL OF LADING<\/h5>
\n

A waybill must be completed for each shipment. Each item listed on it must be clearly identified with the name of the consignee<\/strong> and the destination<\/strong>.<\/p>\n\n\n\n

If the service level<\/strong> is not specified on the waybill \/ bill of lading, the delivery mode \u201cSTANDARD\u201d<\/strong> will be applied.<\/p>\n<\/div><\/div>\n\n\n\n

SERVICE LEVEL terms<\/h5>
\n

All service levels indicated on the waybill \/ bill of lading are not guaranteed<\/strong> and may change due to unforeseen circumstances.<\/p>\n<\/div><\/div>\n\n\n\n

C.O.D. SHIPMENT<\/h5>
\n

The carrier will not deliver a C.O.D. shipment<\/strong> until full payment<\/strong> has been received. Collection and transfer fees are the responsibility of the party paying the transportation charges<\/strong>. The carrier will not be responsible for the validity of the method of payment<\/strong>.<\/p>\n<\/div><\/div>\n\n\n\n

 DELAY<\/h5>
\n

Unless the parties agree otherwise in writing, the carrier is not liable for special, consequential or other damages<\/strong> resulting from mere delay, whatever the cause.<\/p>\n<\/div><\/div>\n\n\n\n

DECLARED VALUE OF SHIPMENTS AND MAXIMUM LIABILITY<\/strong><\/h6>
\n

Liability for any loss or damage is limited to $2.00\/lb or $4.41\/kg<\/strong>, calculated on the total weight of the shipment.<\/p>\n\n\n\n

Maximum liability will not exceed twice the cost of transportation<\/strong>, except where:<\/p>\n\n\n\n

a)   <\/strong>The shipper and carrier specifically agree otherwise in writing and the or class of shipper is named on the carriers cargo insurance policy; or<\/p>\n\n\n\n

b)   <\/strong>A higher value is declared on the waybill and an additional charge of 2%<\/strong> of that value is paid.The carrier is not required to accept<\/strong> a shipment whose declared value exceeds 500 $<\/strong>, unless prior agreement in writing<\/strong>.<\/p>\n<\/div><\/div>\n\n\n\n

EXCEPTIONS FROM LIABILITY<\/h5>
\n

The carrier is not liable<\/strong> in the event of loss, damage or delay caused by an act of God, an act of the Crown or public enemies, riots, strikes, a defect or inherent vice in the goods, an act or fault of the shipper, owner or consignee, the authority of law, a quarantine measure, or variations in the weight of grain, seed or other goods attributable to natural loss of weight.<\/p>\n<\/div><\/div>\n\n\n\n

RECOVERY FROM CONNECTING CARRIER<\/h5>
\n

The initial or final carrier may recover losses from the intermediate carriers involved in the transit. Claims for concealed damage will be apportioned in proportion to the revenue received<\/strong>.<\/p>\n<\/div><\/div>\n\n\n\n

NOTICE OF CLAIM (Loss or Damage)<\/h5>
\n

– No carrier is liable<\/strong> for loss, damage or delay to goods carried under the waybill, unless written notice<\/strong> is given to the originating carrier or the delivering carrier within thirty (30) days<\/strong> following delivery of the goods, specifying: the origin, the destination, the date of shipment, and the estimated amount of the claim.
In the case of non-delivery<\/strong>, this notice must be given within nine (9) months<\/strong> from the date of shipment.<\/p>\n\n\n\n

<\/p>\n\n\n\n

\u2013 The final statement of claim must be submitted within 9 months<\/strong>, together with the paid transportation invoice<\/strong>.<\/p>\n<\/div><\/div>\n\n\n\n

STOPPAGE IN TRANSIT<\/h5>
\n

If the goods are stopped or stored in transit upon request, they are at the risk of the requesting party<\/strong>.<\/p>\n<\/div><\/div>\n\n\n\n

ROUTING BY CARRIER<\/strong><\/h5>
\n

In case of physical necessity where the carrier forwards the goods by a conveyance that is not a licensed for-hire vehicle, the liability of the carrier is the same as though the entire carriage were license for-hire vehicle.<\/p>\n\n\n\n

<\/p>\n<\/div><\/div>\n\n\n\n

DANGEROUS GOODS<\/h5>
\n

Any person, acting as agent or principal, who ships dangerous goods without disclosing them<\/strong>, shall indemnify<\/strong> the carrier for any damage, loss or delay. Q-Trans does not accept<\/strong> the following goods: Explosives (1.1 to 1.6), Flammable gases (2.1), Toxic gases (2.3), Water-reactive substances (4.3), Infectious substances (6.2), Radioactive materials (class 7)<\/p>\n\n\n\n

Weight<\/h5>
\n

It is the shipper\u2019s responsibility<\/strong> to state the exact weight<\/strong> on the waybill. If the actual or cubed weight differs, the carrier reserves the right to correct it<\/strong>.<\/p>\n<\/div><\/div>\n\n\n\n

SHIPPERS LOAD COUNT (SLC)<\/h5>
\n

 When the loading is performed by the shipper<\/strong>, the carrier cannot confirm the piece count<\/strong>. Only the number of pallets<\/strong> or skids<\/strong> is taken into account.<\/p>\n\n\n\n

Loading<\/h5>
\n

The loading of the goods<\/strong> is the shipper\u2019s responsibility<\/strong>. It must be suited to the type of goods and facilitate the unloading at destination<\/strong>.<\/p>\n<\/div><\/div>\n\n\n\n
